Confidentiality

Certain information concerning the customer may be shared with third parties, as in address details for dispatching an order. Such details are regarded as highly confidential and all due diligence and contracts have been signed with the third parties to ensure privacy. Details are further shared if legally required to do so to the appropriate authorities. We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

Services and Offers

XPNS reserve the right to provide users services and offerings either directly or through its entities, partners and third parties. By availing these services and offers the user is deemed to have given his/her consent for the same along with having agreed to the associated terms and conditions. User acknowledges that by availing the services offered of by XPNS partners and third parties, XPNS is not part of the contract and acts merely as intermediary. XPNS reserves the right to disqualify any user from any offer or service in case they do not meet the eligibility criteria for such an offer or service or any other reasons thereof including but not limited to misuse of offer, misrepresentation, fraud, or suspicious transactions/activities, including but not limited to PMLA directives or any at our sole discretion without further notice.

Communication Policy

By accepting the terms and conditions the customer accepts that XPNS may send the alerts to the mobile phone number provided by the customer while registering for the service or to any such number replaced and informed by the customer. The customer acknowledges that the alerts will be received only if the mobile phone is in ‘On’ mode to receive the SMS. If the mobile phone is in ‘Off’ mode then the customer may not get / get after delay any alerts sent during such period. The customer acknowledges that the SMS service provided by XPNS is an additional facility provided for the customer’s convenience and that it may be susceptible to error, omission and/ or inaccuracy. In the event the customer observes any error in the information provided in the alert, XPNS shall be immediately informed about the same by the customer and XPNS will make best possible efforts to rectify the error as early as possible. The customer shall not hold XPNS liable for any loss, damages, claim, expense including legal cost that may be incurred/ suffered by the customer on account of the SMS facility. Customer also agrees to receive information regarding what XPNS perceives to be of their interest based on usage history via SMS, Email & Phone call. This includes offers, discounts and general information. In case the customer does not want such information, they have to explicitly ask to be excluded. Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

General

The laws of Republic of India govern these terms and conditions. By accessing this website [and using our services/buying our products] you consent to these terms and conditions and to the exclusive jurisdiction of the Indian courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the Company to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorised representatives of the Company.

Notification of Changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail will be made to those affected by this change. Terms and Conditions for XPNS Propel Card (henceforth known as card)

  1. This Card is issued by XPNS Prepaid Ocean Services Pvt. Ltd (henceforth known as Zaggle). If found, please return to XPNS, Unit No 603, 6th floor, Hyde Park , Survey No. 680, Opp. Ansa Industrial Estate, Saki-Vihar Road, Andheri (E), Mumbai-400 072
  2. This Card is the sole property of XPNS.
  3. By using, attempting to use or accepting to take possession/custody of this card in the physical form or by keeping a copy of this card in the electronic format the cardholder agrees to agree to the terms and conditions applicable to this Card.
  4. This card is redeemable only against products/ vouchers/ cards/ merchandise/ goods or services purchased or redeemed on www.xpns.com and for only those products/ /vouchers/cards/ merchandise/goods or services whose redemption or purchase is approved by the entity who has paid to load the card.
  5. This Card is not redeemable for Cash.
  6. This Card is a non-reloadable card.
  7. To redeem on www.xpns.com you must first sign up on the website or mobile app and then add the card.
  8. In the event any “Know Your Customer” (KYC) or any other details furnished are found to be incorrect XPNS retains the right to cancel the Card and the redemption orders placed using this Card.
  9. XPNS reserves the right to share the information supplied by you with appropriate regulatory or government authorities as is required by law.
  10. XPNS reserves the right to use the data shared by the Cardholder for reasonable business purposes including but not restricted to marketing and promotional activities.
  11. The Validity of the card will be printed on the back of the card. In case of electronic XPNS Propel Card which may be dispatched to the card holder via electronic mail or short message service (SMS) message the expiry date may be mentioned in the electronic mail or short message service (SMS) message. In case the validity is not printed on the card or not visible due to wear and tear, the validity of the card is deemed to be 6 months from the date of issue.
  12. Any unredeemed value or unutilized balance on this card after the date of expiry of the card will stand forfeited.
  13. In case the value of the redeemed goods is greater than the balance of the Card the difference must be paid by Debit or Credit Cards or Net Banking.
  14. In case the value of the redeemed goods is less than the balance of the Card the difference can be used to purchase products at a later date and no cash will be refunded.
  15. The cardholder is responsible for ensuring completeness of the shipping address to ensure delivery of orders.
  16. The redeemed products are dispatched by courier to the address given by the customer at the time of ordering. It’s the cardholders’ responsibility to check the dispatch status and ensure his/her availability at the time of delivery of the consignment.
  17. XPNS cannot be held responsible for non receipt electronic mails sent to the Cardholder due to any reason including but not limited to incorrect email address, electronic mails going to spam/junk folders instead of inbox, change in electronic mail address, connectivity or network failures.
  18. The Card is not transferable without the written permission of XPNS.
  19. Protect the Card Number to avoid misuse.
  20. XPNS is not responsible if the card or the card number are stolen, lost or misused.
  21. XPNS shall not be held responsible for any fraud or misuse of this card and the cardholder agrees to be personally liable for any and all costs, taxes, charges, claims or liabilities of any nature, arising due to any such fraud or misuse of this card.
  22. The Cardholder agrees to use this card and the redeemed products only for lawful purposes and will ensure not to use the Card or the redeemed products for any illegal/criminal/money laundering/terrorist activities.
  23. All transactions done or attempted using the Card and all product /vouchers/cards/ merchandise/ goods or services purchased / redeemed or availed using this Card are subject to Indian law.
  24. The Card cannot be revalidated after expiry.
  25. XPNS shall not be liable/responsible for any defect or non acceptance in any product /vouchers/cards/ merchandise/ goods or services purchased / redeemed or availed using this Card. Any dispute or claim regarding product/ vouchers /cards/merchandise/goods or services purchased / availed using this card must be resolved with respective merchants who supplied or having committed to honour these products/ vouchers /cards/ merchandise/goods or services.
  26. Handling charges applicable.
  27. Shipping charges are applicable but may be waived from time to time as a gesture of good faith. Waiver of any fees or charges on one occasion cannot be constructed as a promise or commitment of future waiver of fees or charges.
  28. Return of Products/ vouchers/ cards/ merchandise/ goods or services that have been purchased or redeemed are the sole discretion of XPNS.
  29. XPNS reserves the right to send replaced products/ vouchers/ cards/ merchandise/ good or services of the same value in case the products/ vouchers/ cards/ merchandise/ goods or services requested for are unavailable.
  30. XPNS reserves the right to alter, delete, insert, revise and modify these terms and conditions from time to time without any prior notice or intimation to the cardholder. It is the Cardholders responsibility to visit the website www.xpns.com periodically to review the terms and conditions.
  31. XPNS reserves the right at any time to refuse for any reason whatsoever, the use of this Card in any manner.
  32. XPNS reserves the right to block, deactivate, cancel this card at any time to refuse for any reason whatsoever including but not limited to fraud, suspected fraud, privacy law violations, abuse, misuse, unethical use of the card.
  33. The Cardholder hereby agree to indemnify and keep XPNS Prepaid Ocean Services Pvt. Ltd. indemnified from and against all actions, claims, demands, proceedings, losses, damages, personal injury, costs, charges and expenses whatsoever which XPNS may at anytime incur, sustain, suffer in respect of the cardholders use of Card or otherwise. Unless, expressly provided herein, XPNS disclaims any liability to the cardholder in this regard.
  34. For resolving any dispute, the Cardholder is asked to write to XPNS Prepaid Ocean Services Pvt. Ltd., Unit No 603, 6th floor, Hyde Park , Survey No. 680, Opp. Ansa Industrial Estate, Saki-Vihar Road, Andheri (E), Mumbai-400 072 or email to [email protected]. Each of these disputes will be considered carefully and addressed purely on the merits of case. The decision of XPNS is final and binding this regard. These terms and conditions form part of the Agreement between the Customer and Ourselves. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.

Terms and Conditions for Kuber Gift Card (‘Card’)

  1. You agree to be bound by these Terms and Conditions by purchasing, activating, using or attempting to use the Card or making transaction enquiries or exercising any right to redeem the value loaded on the Card. If you are giving the Card to another person, you should ensure that they are aware of the Terms and Conditions that apply to the Card. The user of the Card is advised to sign at the appropriate place provided on the reverse side of the Card before its use. The Card remains the property of the RBL Bank Limited (“Bank”).
  2. The Card is a Visa Prepaid card that can be used after activation for purchasing goods and services only in India.
  3. The Card cannot be used to make transactions that exceed the available balance. For such a transaction you will need to pay the difference by another method if the merchant agrees.
  4. The Card is not reloadable. It is valid until the expiry date mentioned on the front of the Card and cannot be used after expiry.
  5. XPNS Prepaid Ocean Services Pvt. Ltd. (“Zaggle”) will send you an SMS 45 days before card expiry notifying you of the same. If there is no response with address seeking an extension of PPI validity via reissuance of a fresh PPI, consent is deemed to have been given for transferring the PPI balance back to the source account. Kindly ensure that the contact information is kept up to date.
  6. The Card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular installment payments.
  7. The Card cannot be used at any ATM’s for cash withdrawals or any other activity at an ATM. However, if the Card is attempted to be used at an ATM, you will be charged a fee of Rs 25/- per attempt even though the transaction is declined by the ATM.
  8. You are responsible for all transactions on the Card. If you notice any error relating to the Card, you should notify us at 1860 500 1231 (Monday to Saturday 10:00 AM to 7:00 PM) or at [email protected]
  9. If you have a problem with a purchase made with the Card, or a dispute with a merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant you can contact 1860 500 1231 (Monday to Saturday 10:00 AM to 7:00 PM) or at [email protected]
  10. The Bank and/or XPNS reserves the right to place a stop on your Card if: (a) You report that your Card has been lost, stolen or damaged; or (b) The Bank and/or XPNS believes (or reasonably suspects) that the Card has been used (or will be used) contrary to these Terms and Conditions.
  11. The Bank and/or XPNS may issue a replacement Card to you against such lost, stolen or damaged Card, upon a request being made by you, in this regard and at our sole discretion. A fee of Rs 350 plus GST would be applicable.
  12. A revalidation fee of Rs 350 plus GST would be recoverable/applicable, on any revalidation requests if made.
  13. An inactivity fee of 5% would be charged/recoverable on a quarterly basis on the unutilized balances from the date of expiry of the card. The entire balance of the card can be accessed as inactivity fee.
  14. Any refunds on Card transactions are subject to the policy of the specific merchant. Refunds may be in the form of a credit to the Card, cash refund or in-store credit. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds.
  15. You are responsible for checking your transaction history online and knowing your available balance. You can check your balance on the website www.xpns.com or by calling XPNS on 1860 500 1231 (Monday to Saturday 10:00 AM to 7:00 PM).

Notwithstanding anything contained herein above, the user hereby accepts and confirms that as a pre-condition to the use of the Card, the user hereby agrees and gives consent to the disclosure by the Bank and/or XPNS of all or any such: (i) Information and data relating to the Card / user; (ii) Information or data relating to any of the terms of this Agreement; and (iii) Default, committed by the user in discharge of the obligation contained herein; as the Bank and/or XPNS may deem appropriate and necessary, to disclose and furnish to Credit Information Bureau (India) Ltd. And any other agency authorised in this behalf by Reserve Bank of India or any other regulatory authority.
  19. You hereby agree to indemnify and keep the Bank and XPNS Prepaid Ocean Services Pvt. Ltd. Indemnified from and against all actions, claims, demands, proceedings, losses, damages, personal injury, costs, charges and expenses whatsoever which the Bank or XPNS may at any time incur, sustain, suffer in respect of your use of Card or otherwise. Unless, expressly provided herein, the Bank & XPNS disclaims any liability to you in this regard.
  20. The Bank and/or XPNS reserves the right to change these Terms and Conditions and all fees and charges related to the Card at any time at its sole discretion. The same shall be updated on our website www.xpns.com. All fees and charges related to the Card will be recovered by a debit to the Card or through other means as available and applicable.
  21. These Terms and Conditions will be governed by and be construed to in accordance with the laws of India. All disputes are subject to the exclusive jurisdiction of the Courts in Mumbai.

Terms and Conditions for Wave Gift Card (‘Card’)

  1. You agree to be bound by these Terms and Conditions by purchasing, activating, using or attempting to use the Card or making transaction enquiry or exercising any right to redeem value loaded on the Card. If you are giving the Card to another person, you should ensure that he or she is aware of the Terms and Conditions that apply to the Card. The user of the Card is advised to sign at the appropriate place provided on the reverse side of the Card before its use. The Card remains the property of RBL Bank Limited (“Bank”).
  2. The Card is a Visa Prepaid card that can be used after activation for purchasing goods and services only in India and only at the merchant partners mentioned on the reverse of the Card and this welcome letter.
  3. The Card cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the merchant agrees.
  4. The Card is not reloadable. It is valid until the expiry date mentioned on the front of the Card and cannot be used after expiry. The Card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular installment payments.

Notwithstanding anything contained hereinabove, the user hereby accepts and confirms that as a pre-condition to the use of the Card, the user hereby agrees and gives consent to the disclosure by the Bank and/or XPNS of all or any such: (i) Information and data relating to the Card / user; (ii) Information or data relating to any of the terms of this Agreement; and (iii) Default, committed by the user in discharge of the obligation contained herein; as the Bank and/or XPNS may deem appropriate and necessary, to disclose and furnish to Credit Information Bureau (India) Ltd. and any other agency authorized in this behalf by Reserve Bank of India or any other regulatory authority.
  19. You hereby agree to indemnify and keep the Bank and XPNS indemnified from and against all actions, claims, demands, proceedings, losses, damages, personal injury, costs, charges and expenses whatsoever which the Bank or XPNS may at any time incur, sustain, suffer in respect of your use of Card or otherwise. Unless, expressly provided herein, the Bank & XPNS disclaims any liability to you in this regard.
  20. The Bank and/or XPNS reserves the right to change these Terms and Conditions and all fees and charges related to Card at any time at its sole discretion. The same shall be updated on our website www.xpns.com. All fees and charges related to Card will be recovered by a debit to the Card or through other means as available and applicable.
  21. These Terms and Conditions will be governed by and be construed in accordance with the laws of India. All disputes are subject to the exclusive jurisdiction of the Courts in Mumbai.
  22. The Wave Card cannot be used to purchase mobile phones, 22 & 24 Carat gold coins and Jewellery at Landmark Stores.
  23. The Wave Card cannot be used at Coffee Day Square, Airport Cafes, Clubs and any other Franchise outlets of Café Coffee Day.
  24. The Wave Card cannot be used to purchase gold at Lifestyle Stores.

Terms and Conditions for Kohinoor Gift Card (‘Card’)

  1. You agree to be bound by these Terms and Conditions by purchasing, activating, using or attempting to use the Card or making transaction enquiry or exercising any right to redeem value loaded on the Card. If you are giving the Card to another person, you should ensure that he or she is aware of the Terms and Conditions that apply to the Card. The user of the Card is advised to sign at the appropriate place provided on the reverse side of the Card before its use. The Card remains the property of RBL Bank Limited (“Bank”).
  2. The Card is a Visa Prepaid card that can be used after activation for purchasing goods and services only in India and only at Gold and Jewellery Merchants registered with VISA as Jewellery stores.
  3. The Card cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the merchant agrees.
  4. The Card is not reloadable. It is valid until the expiry date mentioned on the front of the Card and cannot be used after expiry.
  5. XPNS Prepaid Ocean Services Pvt. Ltd. (“Zaggle”) will send you an SMS 45 days before card expiry notifying you of the same. If there is no response with address seeking an extension of PPI validity via reissuance of a fresh PPI, consent is deemed to have been given for transferring the PPI balance back to the source account.   6. The Card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular installment payments.
  7. The Card cannot be used at any ATM’s for cash withdrawals or any other activity at an ATM. However, if the Card is attempted to be used at an ATM, you will be charged a fee of Rs 25/- per attempt even though the transaction is declined by the ATM.

  10. The Bank and/or XPNS reserves the right to place a stop on your Card if you report that your Card has been lost, stolen or damaged; or the Bank and/or XPNS believes (or reasonably suspects) that the Card has been used (or will be used) contrary to these Terms and Conditions.
  11. The Bank and/or XPNS may issue a replacement Card to you against such lost, stolen or damaged Card, upon a request being made by you, in this regard and at our sole discretion.
  12. Any refunds on Card transactions are subject to the policy of the specific merchant. Refunds may be in the form of a credit to the Card, cash refund or in-store credit. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds.
  13. The Bank and/or XPNS may issue a replacement Card to you against such lost, stolen or damaged Card, upon a request being made by you, in this regard and at our sole discretion. A fee of Rs 350 plus GST would be applicable.
  14. A revalidation fee of Rs 350 plus GST would be recoverable/applicable, on any revalidation requests if made.
  15. An inactivity fee of 5% would be charged/recoverable on a quarterly basis on the unutilized balances from the date of expiry of the card. The entire balance of the card can be accessed as inactivity fee.
  16. You are responsible for checking your transaction history online and knowing your available balance. You can check your balance at the website www.xpns.com or at 1860 500 1231 (Monday to Saturday 10:00 AM to 7:00 PM).

Notwithstanding anything contained hereinabove, the user hereby accepts and confirms that as a pre-condition to the use of the Card, the user hereby agrees and gives consent to the disclosure by the Bank and/or XPNS of all or any such: (i) Information and data relating to the Card / user; (ii) Information or data relating to any of the terms of this Agreement; and (iii) Default, committed by the user in discharge of the obligation contained herein; as the Bank and/or XPNS may deem appropriate and necessary, to disclose and furnish to Credit Information Bureau (India) Ltd. and any other agency authorized in this behalf by Reserve Bank of India or any other regulatory authority.
  20. You hereby agree to indemnify and keep the Bank and XPNS Prepaid Ocean Services Pvt. Ltd. indemnified from and against all actions, claims, demands, proceedings, losses, damages, personal injury, costs, charges and expenses whatsoever which the Bank and/or XPNS may at any time incur, sustain, suffer in respect of your use of Card or otherwise. Unless, expressly provided herein, the Bank & XPNS disclaims any liability to you in this regard.
  21. The Bank and/or XPNS reserves the right to change these Terms and Conditions and all fees and charges related to Card at any time at its sole discretion. The same shall be updated on our website. All fees and charges related to Card will be recovered by a debit to the Card or through other means as available and applicable.
  22. These Terms and Conditions will be governed by and be construed in accordance with the laws of India. All disputes are subject to the exclusive jurisdiction of the Courts in Mumbai.

Communication Policy

The customer acknowledges that the alerts will be received only if the mobile phone is in ‘On’ mode to receive the SMS. If the mobile phone is in ‘Off’ mode then the customer may not get / get after delay any alerts sent during such period. The customer acknowledges that the SMS service provided by XPNS is an additional facility provided for the customer’s convenience and that it may be susceptible to error, omission and/ or inaccuracy. In the event the customer observes any error in the information provided in the alert, XPNS shall be immediately informed about the same by the customer and XPNS will make best possible efforts to rectify the error as early as possible. The customer shall not hold XPNS liable for any loss, damages, claim, expense including legal cost that may be incurred/ suffered by the customer on account of the SMS facility. Customer also agrees to receive information regarding what XPNS perceives to be of their interest based on usage history via SMS, Email & Phone call. This includes offers, discounts and general information. In case the customer does not want such information, they have to explicitly ask to be excluded. Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

General

The laws of Republic of India govern these terms and conditions. By accessing this mobile app[and using our services/buying our products] you consent to these terms and conditions and to the exclusive jurisdiction of the Indian courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorised representatives of the Company.

Notification of Changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the mobile app will signify your acceptance of any adjustment to these terms. The company cannot be held responsible for non receipt electronic mails sent to the mobile app user due to any reason including but not limited to incorrect email address, electronic mails going to spam/junk folders instead of inbox, change in electronic mail address, connectivity or network failures. The company tries its best to ensure that the merchants it signs up provide the best in terms of quality and services. The company shall not be held responsible for any deficiency in services by the said merchants. Any retail brand gift voucher redeemed/purchased on the mobile app and mobile apps hall be covered under the terms and conditions of the corresponding retail brand.

This Prepaid Card is issued to you by XPNS Prepaid Ocean Services Pvt. Ltd. (“Zaggle”) having registered office at 8-2-334/18, 2nd Floor, Salguti House, Rd No. 3, Banjara Hills, Hyderabad – 500034 and sponsored by RBL Bank Limited having registered office at Shahupuri, Kolhapur – 416 001 and corporate office at One Indiabulls Centre, Tower 2B, 6th Floor, 841, Senapati Bapat Marg, Lower Parel, Mumbai- 400 013 (“Bank”)

Most Important Terms & Conditions for RBL Bank – XPNS Zinger Multiwallet Prepaid Card:

The usage of the Co-branded RBL Bank-XPNS Zinger Multiwallet Prepaid Card (“Card”) issued to you (the “Cardholder”) shall be governed by the terms and conditions contained herein in any attachments or accompanying supplement(s) and shall also those terms and conditions stated on the website viz www.xpns.com (together “the Terms”). The Card is made available to the Cardholder by a corporate customer (“Corporate”) of XPNS pursuant to a commercial dealing between the Cardholder and the Corporate. The Cardholder hereby agrees to abide by the Terms and the Cardholder and shall be deemed to have unconditionally agreed to and accepted the Terms by performing first transaction with the Card or acknowledging receipt of the Card in writing or by signing on the reverse of the Card. Cardholder shall comply with all the relevant notifications/ guidelines / circulars issued by the Reserve Bank / Bank/ any other competent authority / statutory or regulatory body/ies governing the issue and use of the Card. The Bank and/or XPNS disclaim all liability on account of any breach by the Cardholder, the Terms or the relevant notifications/ guidelines / circulars governing usage of the Cards in force and from time to time. If the Terms are not acceptable, the Cardholder must not use the Card and immediately return the Card to the Bank and/or Zaggle.

Definitions:

  1. “Application Form” shall mean and include the application submitted/required to be submitted by the Cardholder in the form and manner stipulated by Bank and/or Zaggle, for availing the Card.
  2. ‘ATM’ means Visa/MasterCard/RuPay or any other Card network enabled Automated Teller Machines in India.
  3. “Available Amount” means in relation to a Card, the amount available at a given point of time for use on the Card, being a sum of amount(s) loaded/deposited in the Card Account as reduced by a) the amount(s) utilised by using the Card for transaction(s); and b) charges, costs and expenses on the Card charged XPNS to the Card Account.
  4. “RBL Bank – XPNS Zinger Multiwallet Prepaid Card” or “Card” shall mean a pre-paid MasterCard/Visa/Rupay card issued in terms hereof.
  5. “Card Account” shall mean the account opened in the name of the Card Holder and maintained with XPNS for the purpose of usage of the Card as per the Terms and Conditions contained herein.
  6. “Cash Limit” shall mean the maximum amount of cash that the Card Holder can withdraw through ATMs by using the Card on any given day or for such periods as maybe stipulated by Bank and/or XPNS and as per instructions/directions of regulatory authority, from time to time, provided that in no event shall such amount be more than the amounts loaded in card. Bank and/or XPNS reserves the right to disable cash withdrawal services or revise the Cash Limit based on the request of the Corporate on whose request the Card has been issued to the Cardholder or at its own discretion for any reason whatsoever.
  7. “Charges” means such charges payable by the Card Holder including those as set out in these terms and conditions as amended from time to time by the Bank and/or XPNS at its sole discretion.
  8. “Charge Slip” means voucher printed after using Prepaid Card in a swipe machine/POS to pay for any transactions performed using the card. It indicates the details of the transaction such as the amount, time of the transaction, date, location etc.
  9. “Customer Care Centre” refers to Phone Banking provided by Zaggle, which shall be available to all its Prepaid Cardholders.
  10. “Merchant Establishment” shall mean establishments, wherever located in India, which honour MasterCard/Visa/Rupay Card and shall include among others, stores, shops, restaurants, hotels, airlines, cash advance points including ATMs and mail order advertisers.
  11. ‘PIN’ means the secret Personal Identification Number allocated to the Cardholder by XPNS to enable usage of Card and/or subsequently changed by the Cardholder as per his/her choice, in relation to the Card.
  12. ‘POS’/’EDC’ means Point of Sale/Electronic Data Capturing machines used at Merchant Establishments in India, capable of processing card transactions and at which, the cardholder can use his/her Card to make payments for purchases subject to availability of funds in his Card Account.
  13. “Statement” means a statement made available by XPNS to the Card Holder setting out the financial transactions that have been made using the Card along with balance if any, in the Card Account.
  14. “Schedule of Charges”/ “Tariff Annexure” means an annexure detailing the Charges applicable for the services offered on the Card.
  15. “Transaction Instruction” means any instruction given by a Card Holder, directly or indirectly, to Bank and/or Zaggle, to effect a transaction on the Card.
  16. “Online Transaction” shall mean the buying and selling of goods and services or transmitting of funds or data over an electronic network, primarily Internet.

In these Terms and Conditions, unless the contrary intention appears:

  1. A reference to: an “amendment” includes a supplement, modification, novation, replacement or re-enactment and ‘amended” is to be construed accordingly; an “authorisation” or “approval” includes an authorisation, consent, clearance, approval, permission, resolution, license, exemption, filing and registration; “law” includes any constitution, statute, law, rule, regulation, ordinance, judgement, order, decree, authorisation, or any published, directive, guideline, requirement or governmental restriction having the force of law, or any determination by, or interpretation of any of the foregoing by, any judicial authority, whether in effect as of the date of signing/submission of the Application Form or thereafter and each as amended from time to time.
  2. The singular includes the plural (and vice versa);
  3. The headings in these Standard Terms are inserted for convenience of reference only
  4. Reference to the words “include” or “including” shall be construed without limitation;
  5. Reference to a gender shall include references to the female, male and neuter genders;
  6. All approvals, permissions, consents or acceptance required from Bank and/or XPNS for any matter shall require the prior, written approval, permission, consent or acceptance of Bank and/or XPNS;
  7. In the event of any disagreement or dispute between Bank and/or XPNS and the Card Holder regarding the materiality of any matter including of any event, occurrence, circumstance, change, fact, information, document, authorisation, proceeding, act, omission, claims, breach, default or otherwise, the decision of the Bank and/or XPNS as to the materiality of any of the foregoing shall be final and binding on the Card Holder. The Card Holder shall be bound by these Terms and policies stipulated by Bank and/or Zaggle, from time to time, in this regard.
The Card is not transferable and a zero balance card at the time of issue. The Card holder cannot add his/her personal funds on the Card and funding of the Card may be done only by the Corporate. Bank and/or XPNS shall not be required to reload the Card or otherwise add to the Card Balance, at the request of the Cardholder. Further, Bank and/or XPNS may add or subtract amounts from the Card Balance in accordance with the instructions of the Corporate and Bank and/or XPNS shall not be liable to the Cardholder for any such additions or subtractions. No interest shall be paid or payable by Bank and/or XPNS on the pre-loaded balance on the Card. It shall be subject to the Terms & Conditions mentioned herein and any additional conditions stipulated by Bank and/or XPNS from time to time. The Card Holder shall sign on the reverse of the Card immediately upon receipt of the same, and ensure that the signature on all transaction slips signed by the Card Holder are similar to the signature provided by the Card Holder on the Card and the Application Form submitted to Bank and/or XPNS. In case the Card Holder desires to alter his/her signature, the Card Holder shall intimate the Bank and/or XPNS about the same and execute necessary documents as prescribed by Bank and/or XPNS and/or under law, in this regard.

Use of the Card:

  1. The Card issued is valid for use only in India and for the purchase of goods/services in Indian currency only. The Card will be valid for a period of upto 4 years from the date of issuance.
  2. The Card is valid for use at physical Merchant Establishments, Online Transactions and ATM Cash Withdrawals only.
  3. For the purposes of using the Card, the Card Holder is required to authenticate himself with PIN.
  4. Bank and/or XPNS and the Merchant Establishment concerned, reserve the right, at any time, to refuse the use of the Card. Any charge levied by the Merchant Establishment on the purchase made by the Card Holder using the Card, shall be paid by the Card Holder with the Merchant Establishment directly and Bank and/or XPNS shall not be responsible for the same. Any dispute pertaining to such charges levied shall be settled between the Card Holder and the concerned Merchant Establishment. Bank and/or XPNS shall not be liable in any manner, whatsoever, for the same.
  5. The Card Holder undertakes to act in good faith at all times in relation to all dealings with the Card and Bank and/or XPNS. The Card Holder accepts full responsibility for wrongful use of the Card or any use of the Card in contravention of the Terms contained herein and, undertakes and agrees to indemnify the Bank and/or XPNS to make good any loss, damage, interest, conversion, any other financial charge that Bank and/or XPNS may incur and/or suffer, whether directly or indirectly, as a result of the Card Holder violating the provisions thereof.
  6. The Card Holder agrees that he/she will not use the Card as payment for any illegal purchase. The Card cannot be used for making purchases of prohibited items/services under the applicable laws of India including for any kind of gambling, purchase of lottery tickets, banned or prescribed magazines/services, participation in sweepstakes, payment for call-back services, etc.
  7. As per the RBI guideline on the Issuance and Operation of Prepaid Instruments in India the maximum balance on a prepaid card is regulated based on prevailing RBI guidelines at any given point of time and Bank and/or XPNS reserves the right to modify such limits at its sole discretion from time to time based on then prevailing regulatory guidelines and its internal policies.
  8. Bank and/or XPNS reserves unto itself the absolute discretion and liberty to decline or honour the authorisation requests on the Card, without assigning any reason thereof. The Bank and/or XPNS shall not be liable in any manner whatsoever for decline any transaction.
  9. Bank and/or XPNS may, at its sole discretion, utilize the services of external service provider/s or agents and on such terms as required or necessary, in relation to the Cards.
  10. The Card Holder accepts and acknowledges that Bank and/or XPNS shall not be liable for the services provided by Merchant Establishment to the Card Holder.
  11. The Card Holder accepts and acknowledges that the Card is not transferable or assignable by the Cardholder under any circumstances.
  12. To protect the interest of the Cardholder from an un-authorised use it is advised that you shall keep the Card under your personal custody at all the times, and shall under no circumstances whatsoever allow the Card to be used by any other individual. The Cardholder will sign on the reverse of the Card in the signature panel immediately upon receipt of the Card from the Bank and/or XPNS.
  13. The Cardholder shall ensure that the PIN is received by him/her in a sealed mailer. The Cardholder should immediately upon receipt of the PIN, shall memorise the PIN and destroy the PIN mailer immediately. The Card holder shall change the PIN to the PIN of his choice by logging on www.xpns.com and shall also change the PIN at regular intervals. Under any circumstances the Card holder should not disclose his/her PIN to anyone. To protect the interest of the Cardholder from an un-authorized use it is advised that you shall keep the Card under your personal custody at all the times, and shall under no circumstances whatsoever allow the Card to be used by any other individual. The Cardholder shall be solely responsible for the consequences arising out of the disclosure of his/her PIN, including any unauthorized use of the Card. Any instructions given by means of the Card and the PIN, whether in conjunction or independently shall be deemed to be instructions given by the Cardholder, and the Bank and/or XPNS shall be entitled to assume that those instructions are given by the Cardholder.

Breach & Termination/Withdrawal /Expiry:

  1. Breach: In the event of any breach of these Terms & Conditions by any Card Holder:
    1. Not with standing any other provision of these Terms & Conditions, the Card Holder shall remain liable for any loss, directly or indirectly, resulting from such a breach; and
    2. The Card Holder shall be liable to pay Bank and/or Zaggle, upon demand, all amounts outstanding from the Card Holder.
  2. Termination:
    1. (a) The Card Holder may at any point of time, by giving 15 days prior notice in writing to the Bank and/or XPNS and/or the corporate request for termination of the Card. (b) Such a notice shall not take effect till the Card has been defaced by Card Holder by cutting off the top right- hand corner ensuring that both the hologram and magnetic stripe have been cut, and has been received by Bank and/or XPNS.
    2. In the event Charges are incurred on the Card after the Card Holder claims to have destroyed the Card, the Card Holder shall be entirely liable for Charges incurred on the Card.
    3. Bank and/or XPNS may at any time, with a notice of 7 days or without any notice as to the circumstances in Bank’s and/or Zaggle’s absolute discretion require, terminate the Card facility.
    4. Bank and /or XPNS at its sole discretion, reserves the right to, either temporarily or permanently, withdraw the privileges on the Card and/or cancel the Card at any time with a notice of 7 days or without giving any notice or assigning any reason thereof. In case of a temporary withdrawal, the privileges may be reinstated by Bank and/or XPNS at its sole discretion. In case of a permanent withdrawal, Bank and/or XPNS have a right to refuse membership to the Card Holder permanently. In the event of such temporary or permanent withdrawal, the Card Holder shall continue to be fully liable for all charges incurred on the Card prior to such withdrawal, together with all other applicable charges thereon, unless otherwise specified by Bank and/or XPNS.
  3. The Bank and/or XPNS shall terminate the Card with immediate effect upon the occurrence of any of the following events:
    1. the Cardholder intimating the loss of the Card;
    2. any breach of terms and conditions by the Cardholder;
    3. upon specific request from the Cardholder to cancel or suspend the Card;
    4. Bank and/or XPNS is unable or otherwise prevented from processing payments in relation to the Card for reasons beyond its reasonable control (including but not limited to restrictions imposed by law or regulation);
    5. Demise of the Cardholder;
    6. Reported lunacy/insanity/unsound mind of the Cardholder;
    7. If the Bank and/or XPNS deems that the facility is being misused / improperly used in anyway;
    8. If any adverse report is received from any of the Banks/ Branches and/or XPNS in the network or from any governing or monitoring authority.
    Notice of withdrawal or request to surrender shall be deemed given when a notice posted to the mailing address of the Card Holder, as per the records of Bank and/or Zaggle, is received by the Card Holder through ordinary post. The Card Holder agrees to surrender the Card to Bank and/or Zaggle, or its representative, upon being requested to do so.
  4. ExpiryXPNS Prepaid Ocean Services Pvt. Ltd. (“Zaggle”) will send you an SMS 45 days before card expiry notifying you of the same. If there is no response with address seeking an extension of PPI validity via reissuance of a fresh PPI, consent is deemed to have been given for transferring the PPI balance back to the source account. Kindly ensure that the contact information is kept up to date.

Charges:

  1. Charges shall include voluntary and involuntary charge, details of which are given hereunder:
    1. Voluntary charge:
      1. The amount of any purchase of any goods or services made by a transaction instruction.
      2. Any amount which the Card Holder has requested Bank and/or XPNS to debit the card account with, by virtue of a transaction instruction.
    2. Involuntary charge:
      1. Any fees charged by Bank and/or XPNS in respect of the Card, including replacement, renewal, handling and other fees, if any. These fees are non-refundable.
      2. A Service charges on specific types of transactions. The method of computation of such charges will be as notified by Bank and/or Zaggle, from time to time.
  2. Bank’s and/or Zaggle’s record of the amount of any charge shall, in the absence of manifest error, be final and binding on the Card Holder, and shall be conclusive in any case where Bank and/or XPNS has effected any payment.
  3. All statutory taxes, GST, all other duties (including stamp duty and relevant registration charges, if any, in connection with the card) and taxes ( of any description whatsoever) as may be levied from time to time by the government or other authority in respect of or in connection with the card, will be borne by the Card Holder. For details on charges, refer to tariff annexure enclosed as part of this Terms of Use. These charges are subject to changes at the sole discretion of Bank and/or XPNS and the same shall be binding on the Card holder.

Lost, stolen or misuse of Prepaid Cards:

If a card is lost or stolen, the Card Holder must immediately report such loss/theft to customer care centre of Zaggle, the details of which are mentioned at the back side of the Card and/or the Corporate. However, in case of loss of Card due to theft, the Card Holder must also file an FIR with the local police and should be able to produce a copy of the same upon request by the Bank and/or Zaggle. XPNS will, upon adequate verification, suspend the card and terminate all facilities in relation thereto and will not be liable for the inconvenience caused to the Card Holder. The Card Holder shall take cognizance of the fact that once a Card is reported lost, stolen or damaged, the Card cannot be used again, even if found subsequently. The Card Holder declares that if a Card is reported lost, stolen or damaged, it shall not be used again, even if found or said to be in damaged condition subsequently, in such cases, the Card Holder shall promptly cut the card in 4 pieces and return the same to Bank and/or XPNS for cancellation with a due information to the Corporate. No liability shall accrue upon the Card Holder for any unauthorized transactions done on the card from the time such card has been reported lost/ stolen/ damaged to XPNS and upon XPNS having suspended the card. However in the event that Bank and/or XPNS determines that the Card Holder has failed to take the steps as mentioned above in case of loss / theft / damaged / destruction of the card and the same are questionable, financial liability on the lost, stolen or damaged card if any incurred thereafter would rest with the Card Holder only and could even result in cancellation of the card. In case of any dispute relating to the time of reporting and/ or transaction/s made on the card, post reporting of the said card as being lost/ stolen/ misused, Bank and/or XPNS shall reserve the right to ascertain the time and/ or the authenticity of the disputed transaction. Any such dispute in this regard shall be settled between the Card Holder and Corporate directly and in line with the Grievance Management Policy as updated on website www.xpns.com.

Exclusion of liability:

Without prejudice to the foregoing, Bank and/or XPNS shall be under no liability, whatsoever, to the Card Holder, in respect of any loss or damage arising, directly or indirectly, out of:
  1. Any defect in any goods or services supplied,
  2. The refusal of any person to honour or accept the Card,
  3. The malfunction of any computer terminal/ system not within the Bank’s and/or Zaggle’s control,
  4. The exercise by Bank and/or XPNS of its right to demand and procure the surrender of the Card prior to the expiry date exposed on its face, whether such demand and surrender is made and/or procured by the Bank and/or XPNS.
  5. Handing over of the Card by the Card Holder to anybody
  6. The exercise by Bank and/or XPNS of its right to terminate the usage of the Card
  7. Any injury to the character and reputation of the Card Holder, to have been caused by the repossession of the card and/or, any request for its return or the refusal of any merchant establishment/mail order establishment to honour or accept the card
  8. Any mis-statement, mis-representation, error or omission in any details disclosed to Bank and/or XPNS.

Disputes/Grievance Redressal /escalation:

Since the transactions using the Card requires authentication by secret PIN known to the Card holder only any charge slip, or other payment requisition irrespective of whether it has the signature of Card holder therein shall be conclusive proof that the charge recorded on such a charge slip or other requisition, was properly incurred by the Card Holder. The other payment requisition referred to in this clause shall include any and all payment pertaining to permissible expenses incurred by a Card Holder for online transactions or at a merchant establishment by use of the card which is not recorded as a charge. Any disputed transaction on the card shall be raised by the cardholder/s with XPNS/Bank’s customer care center only within ninety (90) days from the date of the transaction. Any dispute raised by the cardholder/s after ninety (90) days from the date of the transaction shall not be entertained and the Bank and/or XPNS shall not be liable for the same in any manner whatsoever. Quality of goods & services:

Bank and/or XPNS shall not, in anyway, be responsible for merchandise, merchandise warranty or any services purchased, or availed of by the Card Holder from merchant establishment, including on account of deficiency in services delay in delivery, non-delivery, non-receipt of goods or receipt of defective goods by the Card Holder. It must be distinctly understood that the card is purely a facility to the Card Holder to purchase goods and/or avail of services, Bank and/or XPNS holds out no warranty or makes no representation about quality, delivery or otherwise of the merchandise and of the services provided by the merchant establishment. Any dispute or claim regarding the merchandise or services must be solved by the Card Holder with the merchant establishment. The existence of the claim or dispute shall not relieve the Card Holder of his/her obligation to pay all the charges and the Card Holder agrees to pay promptly such charges, dues, notwithstanding any dispute or claim, whatsoever. However, the Cardholder should notify RBL Bank and/or XPNS of the complaint immediately.

Disclosures:

The Card Holder acknowledges that the information on his/her usage of card is exchanged amongst banks and financial entities that provide corporate facilities. Acceptance of an application for card is based on no adverse reports of the individual’s creditworthiness and compliance of KYC norms. Bank and/or XPNS may report to other banks or financial entities any delinquencies or suspicious activities and/or transactions done on the card, and/or withdrawal of the Card Holder’s facility to use the card. Based on the receipt of adverse reports, Bank and/or XPNS may, after 7 days’ prior notice, cancel the card. Bank and/or XPNS shall not be obliged to disclose to the Card Holder the name of the bank or financial entity, from where it received, or to which it disclosed information. The Card Holder shall forthwith notify Bank, XPNS and/or the Corporate of any change in his/her address for communication as stated in the application form for the card. Bank and/or XPNS reserves the right to change the Card Holder’s address in its records if such change in address comes to the notice of Bank and /or XPNS. The responsibility shall be solely of the Card Holder to ensure that Bank, XPNS and/or the Corporate has been informed of the correct address for communication, and Bank and/or XPNS disclaims all liability in case of an incorrect address resulting in any loss or liability for the Card Holder. The Card Holder agrees to adhere to and comply with all such terms & conditions as Bank, XPNS or its affiliates may prescribe, from time to time, for facilities/services availed of by the Card Holder. The Card Holder authorizes the Bank and/or XPNS to disclose all any information or documents about the Card Holder including these Terms and Conditions, transactions or dealings between the Card Holder and the Bank and/or XPNS for any purpose to
  1. Its head office or to any other branches, subsidiaries or associated or affiliated companies of the Bank and/or XPNS;
  2. Professional advisers of the Bank and/or XPNS;
  3. Any potential or actual purchaser/assignee of the Bank and/or XPNS or of any of its businesses, rights, assets or obligations; or
  4. To any other person where disclosure is required by law

Governing Law and Jurisdiction:

All disputes are subject to the exclusive jurisdiction of the competent courts in Mumbai only and the laws applicable shall be Indian laws.

Changing these terms & conditions:

Bank and/or XPNS reserves the right to change, at any time, these terms & conditions, features and benefits offered on the card including, without limitation to, changes which affect existing balances or rates. The Card Holder shall be liable for all charges incurred and all other obligations under these revised terms. Bank and/or XPNS may communicate the amended terms and conditions by hosting the same on its website or in any other manner as decided by the Bank and/or XPNS. The Card Holder shall be responsible for regularly reviewing these terms and conditions including amendments thereto as may be posted on the website of Bank and/or XPNS and shall be deemed to have accepted the amended terms and conditions by continuing to use the card.

Indemnity:

The Cardholder hereby agrees to indemnify and keep the Bank and /or XPNS indemnified from and against all actions, claims, demands, proceedings, losses, damages, personal inquiry costs charges and expenses which the Bank and/or XPNS may at any time incur, sustain, suffer or be put to as a consequence of or by reason of or arising out of providing the Cardholder, said facility of the Card or by reason of the Bank and/or XPNS acting in good faith and taking or refusing to take or omitting to take action on the Cardholder’s instructions and in particular arising directly or indirectly out of the negligence, mistake or misconduct of the Cardholder; breach or non- compliance of the rules, terms and conditions relating to the Card and/or fraud or dishonesty relating to any Transaction by the Cardholder The Cardholder acknowledges that the Bank and/or XPNS shall not be responsible nor shall they be liable to indemnify the Cardholder in the event of any loss or damage suffered by the Cardholder due to any cause or reason beyond the control of the Bank and/or XPNS like, but not limited to, misplacement of Card or PIN by the courier, or loss-in-transit of the Card/PIN mailer, mechanical or technical failure and down time, connectivity down time etc. Without prejudice to the foregoing, the Bank and/or XPNS shall be under no liability whatsoever to the Cardholder in respect of any loss or damage arising directly or indirectly use of Card.

Tariff annexure:

  1. The Bank and/or XPNS may issue a replacement Card to you against such lost, stolen or damaged Card, upon a request being made by you, in this regard and at our sole discretion. A fee of Rs 350 plus GST would be applicable.
  2. A revalidation fee of Rs 350 plus GST would be recoverable/applicable, on any revalidation requests if made.
  3. An inactivity fee of 5% would be charged/recoverable on a quarterly basis on the unutilized balances from the date of expiry of the card. The entire balance of the card can be accessed as inactivity fee.

Definitions:In this Terms and Conditions, unless the contrary intention appears and/or the context otherwise requires, capitalized terms defined by: (i) inclusion in quotations and/ or parenthesis have the meanings so ascribed; and (ii) the following terms shall have the meanings assigned to them herein below:
    1. “Account” or “Card Account” refers to a prepaid account with an account balance equivalent to amount loaded on such PPI, for the purpose of monitoring the limits available on such PPI.
    2. “Application Form” shall means as the context may permit or require, the GIFT Prepaid Card application form submitted by the Customer to YES Bank and/or XPNS for the purpose of applying for and/or availing the GIFT Prepaid Card along with all requisite information, particulars, clarifications and declarations, if any, furnished by the Customer from time to time in connection with the GIFT Prepaid Card.
    3. “Business Day” means a day other than a Sunday or Public Holiday as defined under Section 25 of Negotiable Instrument Act, 1881 on which banks are open to transact business of banking.
    4. “Charges” means such levy, costs and charges levied by YES Bank and/or XPNS for usage of the GIFT Prepaid Card, as amended from time to time.
    5. “Customer” or “Holder” shall mean any individual, limited liability partnership firm, partnership, society, company or any other organization or entity under applicable laws, who obtain/purchase PPIs from Bank and/or XPNS and use the same for purchase of goods and services, including financial services, remittance facilities etc. against the value stored on such instruments
    6. “Customer Care Centre” refers to Program Phone Banking Service provided by YES Bank and/or XPNS for addressing all queries, complaints raised by the Customer or any details or information sought by the Customer in relation to the GIFT Prepaid Card.
    7. “Card Agreement” means the agreement or arrangement letter signed and executed by the Customer with YES Bank and/or XPNS for issuance of the GIFT Prepaid Card to its employees/ contractual staff and includes any amendments made thereto from time to time.
    8. “Card” or “YES BANK GIFT Card” or Prepaid Instrument (PPI) shall mean a Prepaid Instrument (“PPIs”-Card/wallet) are payment instruments that facilitate purchase of goods and services, including financial services, remittance facilities etc. against the value stored on such instruments as defined in the Master Direction on Issuance and Operation of Prepaid Payment Instruments dated December 29, 2017.
    9. “EDC” or “Electronic Data Capture” means terminal, printer, other peripheral and accessory and necessary software on which the GIFT Prepaid Card can be swiped or used to initiate a transaction.
    10. “Internet Payment Gateway” means the protocol stipulated/to be stipulated by YES Bank authorizing the payments through the GIFT Prepaid Card via internet upon authentication of the Customer.
    11. “KYC” shall mean Know your Customer guidelines adopted by the Bank for the purpose of identification and verification of the Customer, pursuant to the guidelines, circular and notifications, issued by the Reserve Bank of India, from time to time.
    12. “Merchant Establishments” shall mean such physical establishments including but not limited to stores, shops, restaurants, hotels, located in India, which accept GIFT Prepaid Card or Master Card.
    13. “Personal Identification Number (PIN)” is a numeric password which is part of the kit provided to the Customer by YES Bank and/or XPNS along with the PPI.
    14. “Payment Channel” shall mean various modes of transactions including but not limited to EDC/ POS terminals/kiosks / Internet Payment Gateway and various other modes as intimated by Yes Bank from time to time.
    15. “POS” or “Point of Sale” means electronic terminals maintained by Merchant Establishments in India at which the Customer can use the GIFT Prepaid Card for the purpose of purchasing the goods and services, including financial services, remittance facilities etc.
    16. “Program” shall mean YES Bank XPNS program to offer the GIFT Prepaid Card to the Customer.
    17. “Schedule of Fees/Charges” shall mean the details of fees or charges as may be prescribed by YES Bank and/or XPNS from time to time and displayed on its Website, amended from time to time.
    18. “Statement” means a monthly statement of the GIFT Prepaid Card transaction available in YES Bank’s records setting out the financial transactions that have been carried out or made through the GIFT Prepaid Card, along with the balance, if any, in the Card Account.
    19. “Transaction” means any transaction initiated on the GIFT Prepaid Card by the Customer at any MasterCard affiliated Merchant Establishment, YES Bank ATMs, other bank’s ATMs in India or over the internet.
    20. “Transaction Limit” shall mean the maximum value of purchase that the Customer can make at Merchant Establishment or over the internet directly or indirectly by using the GIFT Prepaid Card on any given day or for such periods as may be stipulated by YES Bank and/or XPNS from time to time, provided that in no event shall such amount be more than the amounts transferred to the GIFT Prepaid Card issued to the Customer, after deducting the aggregate debits made thereon pursuant to the use of the GIFT Prepaid Card by the Customer.
    21. “Website” shall mean the website owned, established and maintained by YES Bank located at the URL: www.yesbank.in or any modifications or amendments thereto from time to time.
    22. “YES Bank” shall mean YES Bank Ltd., a banking company within the meaning of the Companies Act 1956 and a banking company within the meaning of section 5 (c) of the banking Regulation Act, 1949, having its registered office at Nehru Centre, 9th Floor, Discovery of India, Dr A B Road, Worli, Mumbai 400 018.
  2. Interpretations:In these Terms and Conditions, unless the contrary intention appears:
    1. a reference to an “amendment” includes a supplement, modification, novation, replacement or reenactment and “amended” is to be construed accordingly;
    2. an “authorization” or “approval” includes an authorisation, consent, clearance, approval, permission, resolution, license, exemption, filing and registration;
    3. “law” includes any constitution, statute, law, rule, regulation, ordinance, judgment, order, decree, authorisation, or any published directive, guideline, requirement or governmental restriction having the force of law, or any determination by or interpretation of any of the foregoing by any judicial authority, whether in effect as of the date of signing/submission of the Application Form or thereafter, and each as amended from time to time.
    4. “Force Majeure Event” means any event due to any cause beyond the reasonable control of the YES BANK and/or XPNS, including without limitations, unavailability of any communication systems, breach, or virus in the processes or payment or delivery mechanism, sabotage, fire, flood, explosion, acts of god, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage devices, computer crashes, malfunctioning in the computer terminal or the systems getting affected by any malicious, destructive or corrupting code or program, mechanical or technical errors/failures or power shut down, faults or failures in telecommunication etc.
    5. the singular includes the plural and vice versa;
    6. the headings in these Terms and Conditions are inserted for convenience of reference only
    7. reference to the words “include” or “including” shall be construed without limitation;
    8. reference to a gender shall include reference to the female, male and neuter genders;
    9. all approvals, permissions, consents or acceptance required from YES Bank for any matter shall require the prior written approval, permission, consent or acceptance of YES Bank;
    10. in the event of any disagreement or dispute between YES Bank and/or XPNS and the Customer regarding the materiality of any matter including any event, occurrence, circumstance, change, fact, information, document, authorisation, proceeding, act, omission, claims, breach, default or otherwise, the opinion of YES Bank and/or XPNS as to the materiality of any of the foregoing shall be final and binding on the Customer.
  3. Applicability of terms and conditions:
    1. These Terms and Conditions along with the General Terms and Conditions cumulatively form the entire contract between the Customer and YES Bank and/or XPNS for usage of the GIFT Prepaid Card.
    2. The GIFT Prepaid Card shall be issued by YES Bank and/or XPNS, subject to the Customer fulfilling the eligibility criteria as stipulated by YES Bank, from time to time.
    3. The GIFT Prepaid Card shall not be transferable to other individual or party
    4. The maximum credit balance which can be uploaded on the GIFT Prepaid Card shall be limited to INR 10,000/- (Rupees Ten Thousand Only).
    5. The GIFT Prepaid Card shall be valid only within the territory of India and for transactions in Indian Rupees only. The GIFT Card cannot be used outside the territory of India or for any transactions denominated in foreign currency.
    6. The GIFT Prepaid Card is the exclusive property of YES Bank.
    7. The Customer shall be required sign on the reverse side of the GIFT Prepaid Card immediately upon its receipt. YES Bank reserves the right to reject or cancel any Transaction in absence of the signature or mismatch of the signature, without further notice or intimation to the Customer.
    8. YES Bank shall not be liable to pay any interest on any balance maintained in the GIFT Prepaid Card at any point in time.
    9. YES Bank and/or XPNS will inform or intimate the Customer 45 days prior to the expiry of the GIFT Prepaid Card through SMS on the registered mobile number of the Customer. Customer needs to utilize the entire credit balance available on the GIFT Prepaid Card prior to the expiry of the GIFT Prepaid Card. In case the Customer does not utilize the credit balance available on the GIFT Prepaid Card within the validity period, the Customer can approach YES Bank for refund/transfer of outstanding balance to the account maintained with YES Bank or any other bank account of the Customer. In case the Customer does not approach YES Bank within a specified period, the outstanding credit balance available on the GIFT Prepaid Card will be transferred to a Fund in compliance with the regulatory guidelines.
  4. Issuance and usage of the card:
    1. The Customer unconditionally and irrevocably authorizes YES Bank and/or XPNS to deliver and handover the GIFT Prepaid Card to the Customer or the entity which will distribute it to the Customer(s). YES Bank and/or XPNS shall not be liable or responsible for any act or omission on the part of the entity, in connection with the delivery of the GIFT Prepaid Card to the Customer.
    2. YES Bank and the Merchant Establishments, reserves the right to refuse the acceptance of the GIFT Prepaid Card at any time for any reasons whatsoever, without any prior intimation to the Customer.
    3. The GIFT Prepaid Card shall be used only for bonafide personal or official purposes. It is clarified that charges incurred may, in case of certain Merchant Establishments, include a charge for availing certain additional service or other facility being provided by such Merchant Establishments.
    4. The Customer shall sign and retain all the charge slips generated for each of the Transaction consummated at a Merchant Establishment. YES Bank shall not be obliged to provide copies of the charge slips or transaction slips to the Customer. Any such request by the Customer will be at the sole discretion of YES Bank and provided such requests have been made by the Customer within forty-five (45) days from the date of the Transaction. The Customer agrees that YES Bank shall be entitled to charge additional cost or charge for providing copies of the charge or transaction slips
    5. Any charge or cost levied by the Merchant Establishment in relation to any Transaction, shall be directly settled by the Customer with the Merchant Establishment. YES Bank and/or XPNS shall not be liable or responsible, either directly or indirectly, for any act or omission on the part of the Master Merchant or the charges or cost levied by them in relation to the Transaction.
    6. All refunds and adjustments due to any Merchant Establishments on account of device error or communication link will be processed manually and the Card Account will be credited after due verification by YES Bank pursuant to the applicable rules, regulation and internal policy of YES Bank. The Customer agrees that any subsequent Transactions will be accepted or honored only basis the available credit balance in the Card Account(s) without taking into account any disputed amount under consideration by YES Bank. The Customer shall unconditionally keep YES Bank and/or XPNS indemnified against any loss or damage caused to YES Bank and/or XPNS on account of dishonoring the payment instructions as a result of insufficient funds in the Card Account. The Customer agrees that YES Bank shall be entitled to deduct the amount of such loss or damaged caused to YES Bank directly from the Card Account.
    7. The Customer acknowledges that all refunds in case of failed, returned, rejected or cancelled Transactions done by the Customer using any other payment instrument cannot be credited in the GIFT Prepaid Card.
    8. The Card Member undertakes to act in good faith at all times in relation to all dealings in relation to the GIFT Prepaid Card. The Customer accepts full responsibility for any illegal or wrongful use of the GIFT Prepaid Card in contravention to the Terms and Conditions contained herein and, undertakes and agrees to indemnify YES Bank and/or XPNS against any loss, damage, interest, conversion, any other financial charge that YES Bank and/or XPNS may incur and/or suffer, whether directly or indirectly, as a result of the Customer committing any violations of the Terms and Conditions contained herein.
    9. The Customer agrees that he/she will not use the GIFT Prepaid Card for making payment(s) of any goods and services, which is illegal under the Applicable laws. The GIFT Prepaid Card cannot be used for making purchases of prohibited or contraband products or services, e.g. lottery tickets, banned or prohibited magazines, participation in sweepstakes, purchase of bitcoins, payment for call-back services, etc.
    10. The Customer hereby acknowledges and agrees that the GIFT Prepaid Card cannot be reloaded.
    11. The Customer hereby acknowledges and agrees that if there are no Transaction for a consecutive period of one (1) year on the GIFT Prepaid Card, subject to validity of the the GIFT Prepaid Card, the GIFT Prepaid Card shall be made inactive by YES Bank and/or XPNS after sending a notice to the Customer. The GIFT Prepaid Card can only be reactivated by YES Bank and/or XPNS after validations and requisite due diligence, as stipulated by YES Bank, from time to time.
    12. The Customer hereby agrees to receive SMS or emailing alerts from YES Bank and/or XPNS for all Transactions done using the GIFT Prepaid Card. The SMS or emailing alerts from YES Bank and/or XPNS shall stipulate debit and credit Transactions, balance available or remaining on the GIFT Prepaid Card or such other information or details as stipulated by YES Bank and/or XPNS, from time to time.
    13. The Customer agrees and confirms that the Personal Identification Number (“PIN”) shall under no circumstances should be revealed by the Customer to any relative or family members or third party. The Customer shall be solely responsible and liable for the consequences arising out of such unauthorized disclosure of PIN and/or unauthorized usage of the GIFT Prepaid Card. The Customer disclaims all responsibility and liability of YES Bank and/or XPNS arising out of or in connection with the unauthorized usage of the GIFT Prepaid Card and/or any loss or damage, whether direct or indirect, incurred by YES Bank and/or XPNS as a result of such misuse. If the Customer forgets or misplaces the PIN, the Customer should make an application in writing or contact the Customer Care Centre for a new PIN immediately. The new PIN will be sent to the Customer’s registered email address, provided to or available with the YES Bank.
    14. The Customer agrees that YES Bank and/or XPNS may, at its sole discretion, utilize the services of external service provider/s or agent/s and on such terms as required or necessary, in relation to its services.
    15. The Customer shall have access to Frequently Asked Questions (“FAQ”) as uploaded by YES Bank on its Website, from time to time.
  5. Breach:
    1. In the event of any breach of these Terms and conditions by the Customer, YES Bank and/or XPNS shall have the sole right to forthwith cancel or terminate the GIFT Prepaid Card, without any further claim, demand or dispute upon YES Bank and/or XPNS.
    2. The Customer undertakes and agrees to indemnify YES Bank and/or XPNS against any loss, damage, claim, penalty, cost, charges or expenses (including legal counsel fees) that YES Bank and/or XPNS may incur and/or suffer, whether directly or indirectly, as a result of the Customer committing any breach of the Terms and Conditions contained herein.
  6. Term & Termination:
    1. The GIFT Prepaid Card shall be valid for a period of One (1) years from date of printing or until the expiry date printed on the face of the GIFT Prepaid Card.
    2. The Customer agrees and undertakes to destroy the GIFT Prepaid Card upon its expiry to prevent any third party from using it.
    3. The Customer may at any point of time, request for termination of the GIFT Prepaid Card, by giving a prior written notice of thirty (30) days to YES Bank and/or XPNS, save and except, upon request by the Customer for hot listing or blocking the GIFT Prepaid Card, in which case the GIFT Prepaid Card shall be terminated and/or cancelled with immediate effect.
    4. The Customer understands that such notice will not take effect until the GIFT Prepaid Card has been defaced by cutting off the top right-hand corner, ensuring that both the hologram and the magnetic strip have been cut and has been destroyed or received by YES Bank. The Customer agrees that the Customer shall continue to be liable for any Charges incurred on the GIFT Prepaid Card prior to the termination of the GIFT Prepaid Card, irrespective of the fact whether the Customer has or claims to have destroyed the GIFT Prepaid Card.
    5. YES BANK and/or XPNS may at its sole discretion terminate the GIFT Prepaid Card
      1. In the event the Customer is declared insolvent or death of the Customer
      2. In the event of the Customer committing breach of any of the terms, conditions, stipulations or its obligations under these ‘“Terms and Conditions”’
      3. In the event of any restriction imposed on the Customer by an Order of a competent Court or Order issued by any regulatory or statutory authority in India or any investigating agency.
      4. In the event the GIFT Prepaid Card Program becomes illegal under the applicable laws, rules, and guidelines or circular.
      5. In the event the entire GIFT Prepaid Card Program is terminated.
    6. YES Bank and/or XPNS, at its sole discretion, reserves the right to, either temporarily or permanently, withdraw the privileges on the GIFT Prepaid Card and/or terminate the GIFT Prepaid Card at any time without giving any notice or assigning any reason thereof. In case of a temporary withdrawal, the privileges attached to the GIFT Prepaid Card shall be reinstated by YES Bank and/or XPNS at its sole discretion. In case of a permanent withdrawal, YES Bank and/or XPNS has a right to cancel the GIFT Prepaid Card permanently. However, it is made distinctly clear that withdrawal (temporary or permanent) shall constitute automatic withdrawal of all benefits, privileges and services attached to the GIFT Prepaid Card. The Customer agrees that in the event of temporary or permanent withdrawal of the GIFT Prepaid Card, the Customer shall continue to be fully liable for all Charges incurred on the GIFT Prepaid Card prior to such withdrawal, together with all other applicable Charges thereon, unless otherwise specified by YES Bank and/or XPNS.
    7. If YES Bank and/or XPNS temporarily or permanently, withdraw the privileges or terminates the GIFT Prepaid Card, YES Bank and/or XPNS will on best effort basis, promptly notify the Customer. YES Bank and/or XPNS shall not be held liable or responsible for any such delays or laches in receipt of such notification.
    8. Upon termination of the GIFT Prepaid Card as stated above, the balance amount, if any lying in the Card Account shall be refunded to the Customer subject to the payment of applicable charges by way of Pay Order / Demand Draft drawn in favor of the Customer and receipt of written request from the Customer. Customer to submit request with Yes Bank for refund of the balance amount
  7. Notices:Any notice to be given by YES Bank hereunder shall be deemed to have been received by the Customer, within seven (7) days from the date of the notice or email sent by YES Bank at the registered email or mailing address provided to or available with YES Bank. Any notice to be given by the Customer hereunder shall be deemed to have been received by YES Bank only upon acknowledgement of receipt of such notice by YES Bank at its Corporate Office Address at 22nd Floor, Indiabulls Financial Centre, Senapati Bapat Marg, Elphinstone (W), Mumbai – 400013. Any notice or communication from the Customer hereunder shall not be binding on YES Bank unless the same is in writing and shall have been served and acknowledged by YES Bank or if by registered post, acknowledgement card.
  8. Charges:
    1. Charges shall include:
      1. Any fees charged by YES Bank and/or XPNS in respect of the GIFT Prepaid Card, including replacement, renewal, handling and other fees, if any. These fees are non-refundable, non-transferrable and non-assignable in nature.
      2. Service Charges on specific types of Transactions. The method of computation of such Charges will be as notified by YES Bank from time to time on its website:www.yesbank.in.
    2. All Charge, in the absence of manifest error, shall be final and binding on the Customer and shall be conclusive in nature.
    3. All statutory taxes, goods and GST, all other imposts, duties (including stamp duty and relevant registration charges, if any, in connection with the GIFT Prepaid Card) and taxes (of any description whatsoever) as may be levied from time to time by the Government or other authority in respect of or in connection with the GIFT Prepaid Card, will be borne by the Customer.
  9. Cash withdrawal:
    1. As per regulatory guidelines, cash withdrawal is not permitted.
  10. Lost, Stolen Or Misused Gift Prepaid Card:
    1. If the GIFT Prepaid Card is lost or stolen, the Customer must immediately report such loss or theft to Customer Care Centre and request for immediate suspension of the GIFT Prepaid Card.
    2. The Customer acknowledges that once the GIFT Prepaid Card is reported lost, stolen or damaged, such GIFT Prepaid Card cannot be used again, even if found subsequently. The Customer is responsible for the security of the GIFT Prepaid Card and shall take all steps towards ensuring that the GIFT Prepaid Card is not misused. In the event YES Bank and/or XPNS determines or receives any information that the Customer has neglected or refused or failed to take steps as indicated above, in case of loss, theft or destruction of the GIFT Prepaid Card, YES Bank and/or XPNS reserves the sole right to cancel or terminate such GIFT Prepaid Card.
    3. No liability shall accrue upon the Customer for any unauthorized transactions done on the GIFT Prepaid Card, after such GIFT Prepaid Card has been reported lost, stolen or damaged by the Customer. All liabilities accrued on the GIFT Prepaid Card, post reporting by the Customer shall be borne by YES Bank. However, in case of any dispute relating to the time of reporting and/ or transaction/s made on the GIFT Prepaid Card, post reporting of the GIFT Prepaid Card being lost, stolen or misused, all decisions of YES Bank shall be final and binding on the Customer.
  11. Exclusion of Liability:
    1. Without prejudice to the foregoing, YES Bank and/or XPNS shall be under no liability or responsibility to the Customer or any third party, in respect of any loss or damage arising, directly or indirectly out of:
      1. any defect in any goods or services supplied
      2. any disputes regarding the quality, value warranty, delay of delivery, non delivery, non receipt of any goods or services;
      3. the refusal of any person to honour or accept the GIFT Prepaid Card
      4. non functioning of GIFT Prepaid Card in the desired manner for whatsoever reason, or if the ATM is not functioning due whatsoever reasons
      5. the malfunction of any computer terminal
      6. Any Force Majure events
      7. transfer of the GIFT Prepaid Card to any third party.
      8. Termination of the GIFT Prepaid Card by the Customer.
      9. Any loss or damage caused to the Customer alleged to have been caused by the repossession of the GIFT Prepaid Card by YES Bank and/or XPNS.
      10. Any discrepancy between the amount allocated to a GIFT Prepaid Card upon receipt of instructions in this regard from the Customer.
      11. Any reversals done on the GIFT Prepaid Card on request of the Customer.
  12. Disputed transactions:
    1. Any charge or Transaction slip or other payment requisition received by YES Bank and/or XPNS for payment shall be conclusive proof of such Charge, , unless the GIFT Prepaid Card is lost, stolen or fraudulently misused and evidenced by the Customer.
    2. All disputed Transactions in relation to the GIFT Prepaid Card shall be required to be raised with the Customer Care Centre maintained by YES Bank, within fifteen (15 )days from the date of the disputed transaction. The Customer acknowledges that any request, after 15 days from the date of the disputed transaction shall not be accepted by YES Bank.
  13. Quality of Goods and Services:
    1. Any dispute with or complaint against any Merchant Establishment regarding any goods purchased or services availed must be directly resolved by the Customer with the Merchant Establishment.
  14. Disclosures:
    1. The Customer acknowledges and consents to sharing of information pertaining to the Customer and the usage of the GIFT Prepaid Card with any other banks or financial or statutory or regulatory authorities.
    2. The Customer acknowledges and agrees that YES Bank may report to any other banks or financial or statutory or regulatory authorities any Customer delinquencies and/or the usage of the GIFT Prepaid Card. YES Bank shall not be obliged to disclose the details of such banks or financial or statutory or regulatory authorities to the Customer, including the extent of such disclosure.
    3. The Customer hereby authorizes YES Bank and its agents to exchange, share or part with all the information relating to the Customer’s details and payment history with YES Bank’s group companies or Affiliates.
  15. Governing Law and Jurisdiction:
    1. All disputes arising in relation to these Terms and Conditions shall be governed by and construed in accordance with the laws of India and shall be subject to the exclusive jurisdiction of the Courts of Mumbai
  16. Changing these Terms and Conditions:YES Bank reserves the sole right to change, these Terms and conditions, features and benefits offered on the GIFT Prepaid Card, including but not limited to interest charges or rates and methods of calculation.
    1. YES BANK shall communicate the amended Terms and Conditions by hosting them on its website, www.Yesbank.in, or in any other manner as decided by YES Bank.
    2. The Customer shall be responsible for reviewing these Terms and Conditions, including amendments thereto as may be posted on the YES Bank website: www.yesbank.in and shall be deemed to have accepted the amended Terms and Conditions by continuing to use the GIFT Prepaid Card.
  17. Schedule of charges:

  18. Customer Grievance Redressal:
    1. In the event of any dispute or grievance in relation to the GIFT Prepaid Card and/or these Terms and Conditions, the Customer may contact the YES Bank 24 hours Customer Care number at 1800 3000 1113 or Email: [email protected].
    2. In the event the dispute or grievance in relation to the GIFT Prepaid Card and/or these Terms and Conditions is not adequately address or resolved by the YES Bank Customer Care, the Customer may approach the YES Bank Nodal Officer details of which can be found on website of Yes Bank.
    3. YES Bank agrees that all complaints, disputes or grievances raised by the Customer shall be addressed and/or resolved in a time bound manner.
    4. The Customer may at anytime approach the Banking Ombudsman for their grievance redressal.

These Terms and Conditions apply to all transactions involving the use of IndusInd Kuber Card.

  1. You agree to be bound by these terms and conditions by purchasing, activating, using or attempting to use the card or making transaction enquiries or exercising any right to redeem the value loaded on the card. If you are giving the card to another person, you should ensure that they are aware of the terms and conditions that apply to the card. The user of the card is advised to sign at the appropriate place provided on the reverse side of the card before its use. The card remains the property of the IndusInd Bank (“Bank”).
  2. The card is a Visa Prepaid card that can be used after activation for purchasing goods and services only in India.
  3. The card cannot be used to make transactions that exceed the available balance. For such a transaction you will need to pay the difference by another method if the merchant agrees.
  4. The card is not reloadable. The validity of the card is one year. It is valid until the expiry date mentioned on the front of the card and cannot be used after expiry. The card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular installment payments.
  5. XPNS Prepaid Ocean Services Pvt. Ltd. (“Zaggle”) will send you an SMS 45 days before card expiry notifying you of the same. If there is no response with address seeking an extension of PPI validity via reissuance of a fresh PPI, consent is deemed to have been given for transferring the PPI balance back to the source account. Kindly ensure that the contact information is kept up to date.
  6. The card cannot be used at any ATMs for cash withdrawals or any other activity at an ATM. However, if the card is attempted to be used at an ATM, besides the transaction being declined by the ATM, the cardholder will be charged a fee of Rs 25/- per attempt. This account will be deducted from the card balance without further notice.
  7. You shall be responsible for all transactions on the card. If you notice any error relating to the card, you should notify us at 1860 500 1231 (Monday to Saturday 10:00 AM to 07:00 PM) or at [email protected]
  8. If you have a problem with a purchase made with the card, or a dispute with a merchant, you must deal directly with the merchant involved. Neither XPNS nor the Bank shall be responsible for any products and/or services availed by you from any of the merchants.   9. The Bank and /or XPNS reserves the right to place a stop on your card if:
    • You report that your card has been lost, stolen or damaged; or
    • The Bank and/or XPNS believes (or reasonably suspects) that the card has been used (or will be used) contrary to these terms and conditions.
  10. A fuel surcharge of 1.18% or Rs.11.8 whichever is higher will be applied on all fuel purchases.
  11. The Bank and /or XPNS may issue a replacement card to the cardholder against such lost, stolen or damaged card, upon a request being made by you, in this regard and at our sole discretion. A fee of Rs.100 plus taxes shall be applicable for every replacement card that is issued to the cardholder.
  12. Any refunds on card transactions are subject to the policy of the specific merchant. Refunds may be in the form of a credit to the card, cash refund or in-store credit. If the card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the card) then you will have no access to those funds.
  13. You are responsible for checking your transaction history online and knowing your available balance. You can check your balance on the website www.xpns.com or by calling XPNS on 1860 500 1231 (Monday to Saturday 10:00 AM to 07:00 PM) or at [email protected]

  15. Information will be disclosed to third parties about the card, or transactions made with the card, whenever allowed by law, required by law and also where necessary to operate the card and process transactions.
  16. Notwithstanding anything contained herein above, the user hereby accepts and confirms that as a pre-condition to the use of the card, the user hereby agrees and gives consent to the disclosure by the Bank and/or XPNS of all or any such:
    • nformation and data relating to the card / user;
    • Information or data relating to any of the terms of this Agreement; and
    • Default, committed by the user in discharge of the obligation contained herein; as the Bank and/or XPNS may deem appropriate and necessary, to disclose and furnish to Credit Information Bureau (India) Ltd. And any other agency authorised in this behalf by Reserve Bank of India or any other regulatory authority.
  17. You hereby agree to indemnify and keep the Bank and XPNS indemnified and harmless from and against all actions, claims, demands, proceedings, losses, damages, personal injury, costs, charges and expenses whatsoever which Bank or XPNS may at any time incur, sustain, suffer in respect of your use of card or otherwise arising from the card. Unless, expressly provided herein, Bank & XPNS disclaims any liability to you in this regard that may arise from the use of the card.
  18. The Bank and /or XPNS reserves the right to change these terms and conditions anytime and the same shall be updated on our website www.xpns.com and all fees and charges related to the card at any time at its sole discretion. All fees and charges related to the card will be recovered by a debit to the card balance or through other means as available and applicable.
  19. These terms and conditions will be governed by and be construed to in accordance with the laws of India and as per applicable Reserve Bank of India’s Directions on Issuance and Operations of Prepaid Instruments. All disputes are subject to the exclusive jurisdiction of the Courts in Mumbai.
  20. SCHEDULE OF CHARGES: The charges for the Kuber Gift Card:
    Charge Type Fees + GST
    Card Re-validation Fee INR 100.00 + GST
    Lost Card Replacement INR 100.00 + GST

    *GST at 18%

    The user can opt for a card re-validation and Lost Card replacement through a request placed at the customer service number 1860 500 1231 (Monday to Saturday, 10:00 AM to 7:00 PM) or email at [email protected]
    1. The fees + GST will be debited from the available card balance
    2. In the case of a Kuber gift card re-validation request the validity of the card will be 1 year/12 months from date of issue.
    3. In the case of a lost Kuber gift card re-issue request the validity of the card will be 1 year/12 months from date of issue
